Official
Statement on the Shutting Down
of the PGN in Guatemala
Dear Families,
In regards to your adoption case, we have officially received notice
from our Attorney Pedro Cabrera what is happening and where you
all stand as of today Jan 10, 2008.
- We
have been assured by the U.S. State Department that the Guatemalan
government will honor and proceed with adoptions
started before
December 30, 2007. Some in the government
who oppose the adoption process have decided to object
to this “grandfathering
in process”. They know that they can’t change
the law, so they have decided to fight the system with
a number of
new regulations,
knowing they will eventually be forced to comply with the
law. In the mean time, they succeed in causing problems.
The main
regulation they have implemented is that all cases, new
and old, must obtain
an “aviso”, or in other words, register with
the Central Authority. As of Jan 9th, a Central Authority
was announced.
Coincidentally,
the address is the same as the secretary of the Bienestar
Social. This is also the same place where we presented
our papers to
get Eagle’s Nest on the official list of Approved
Children’s
Homes in Guatemala.
Licenciado
Cabrera assures us that the PGN will eventually have to give
in and do their job, but
asks us to advise families of
some sort of a delay. Could be 30 days, or it could
be more.
- What
are we doing in Guatemala? On the 16th of January ALL of
the attorneys will present their requests for
the “aviso” for
each of their families, to Bienestar Social,
a government authority that we assumed might
be or will participate
in what will become
the Central Authority. Since the naming of the
Central Authority yesterday stating the same
address as that
of Bienestar Social,
it is expected that Bienestar Social will receive
the papers of the families. If they refuse to
receive them
the attorneys
plan
an (amparo) Judgment against the PGN. We hope
this will not be necessary.
- We
consider this a positive step, but we are aware
that there is an enormous amount of set up
required for the Central Authority
to do everything they are supposed to do. We
hope that they might start immediately to issue the avisos
for
our families, but at
the same time it would be entirely possible
that they won’t
do anything until they are fully set up to
complete all of their responsibilities which could require
weeks or months.
Interestingly,
on Jan 9, 2008, one of our consultants checked with the PGN
on a particular
case and
was informed that it should
come
out in about 3 weeks, with no mention of
obtaining the “aviso.” Obviously
things are all out of sync and anything
can change even on a daily basis, so please don’t
believe all you read on the internet. Don’t
panic, but keep praying that things will
take positive steps soon.
Please
anticipate updates which we will pass
along as we get the new information.
Since things change
daily
we will wait to
get
an official response from our attorney
before we issue any statements regarding
change.
